Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you and RMA Media LLC, a California limited liability company ("RMA Media," "Bunk," "we," "us," or "our"). They govern your access to and use of the Bunk mobile application, the getbunk.app website, our waitlist, and all related features, content, and services (together, the "Service"). Please read them carefully. By creating an account, joining the waitlist, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

PLEASE READ SECTION 17 (DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER) CAREFULLY. IT REQUIRES YOU AND RMA MEDIA TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT AND WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR JURY TRIAL. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED BELOW.

1. Eligibility

To create an account or use the Service, you represent and warrant that:

  • You are at least 18 years of age. The Service is not directed to and may not be used by anyone under 18. There are no exceptions.
  • You are a current or incoming college or university student, or are otherwise eligible as we may permit.
  • You have the legal capacity to enter into a binding contract with RMA Media and are not barred from using the Service under the laws of the United States or any other applicable jurisdiction.
  • You have never been convicted of, or pleaded no contest to, a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence or the threat of violence, and you are not required to register as a sex offender with any government entity.
  • You will maintain only one account, and you will provide accurate, current, and complete information.

We may require you to verify your identity, age, or student status (for example, through a school-issued email address) before or while using certain features. If any representation above stops being true, you must stop using the Service and delete your account.

2. What Bunk is, and what it is not

Bunk is a platform that helps college students discover, connect, and communicate with potential roommates. We provide tools for creating a profile, browsing and matching with other users, and messaging.

  • We are not a party to any communication, introduction, arrangement, roommate agreement, lease, sublease, tour, payment, or other transaction between users.
  • We are not a real estate broker, landlord, property manager, housing provider, tenant-screening company, or background-check service. We do not list, own, rent, or manage housing, and we make no representation about any room, unit, listing, or living situation.
  • We do not guarantee that you will find a roommate, a match, or housing, or that any user, match, or arrangement will be compatible, safe, suitable, or as described.
  • Compatibility and match scores are automated estimates generated from information users provide. They are offered for convenience only and are not promises or assurances of compatibility, character, or safety.

3. Your account and security

You are responsible for all activity that occurs under your account and for keeping your login credentials confidential. Do not share your account, impersonate any person or entity, misrepresent your affiliation, or create an account for anyone other than yourself. Notify us promptly at support@getbunk.app if you suspect unauthorized use. We are not liable for any loss arising from unauthorized use of your account.

4. Your content and the license you grant

"User Content" means any content you submit to the Service, including your profile details, photos, bio, preferences, and messages. You retain ownership of your User Content. You grant RMA Media a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), publish, and display your User Content solely to operate, provide, secure, and improve the Service. This license ends when you delete your User Content or your account, except that (a) content shared with other users may persist in their copies, and (b) we may retain limited copies as required for legal, safety, or backup purposes.

You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms, any law, or the rights of any third party. You are solely responsible for your User Content.

5. Community guidelines and prohibited conduct

You agree that you will not, and will not attempt to:

  • Harass, bully, stalk, intimidate, threaten, defame, or harm any person;
  • Post or transmit content that is unlawful, hateful, harassing, abusive, defamatory, obscene, sexually explicit, or that depicts or promotes violence or discrimination;
  • Solicit money from, defraud, scam, or deceive other users, or engage in commercial solicitation, advertising, or spam;
  • Use the Service if you are under 18, or contact, solicit, or attempt to meet anyone you know or believe to be a minor;
  • Post another person's private or identifying information, or content you do not have the right to share;
  • Impersonate anyone, create fake or bot accounts, or misrepresent your identity, age, or student status;
  • Scrape, harvest, copy, index, or misuse other users' information or any part of the Service;
  • Reverse engineer, decompile, interfere with, overburden, or attempt to gain unauthorized access to the Service or its systems;
  • Upload viruses or malicious code, or use the Service to violate any law or regulation.

We enforce a zero-tolerance policy for objectionable content and abusive behavior. Violations may result in content removal, warnings, feature limits, suspension, or permanent termination, at our discretion.

6. Objectionable content, reporting, blocking, and moderation

Safety is central to Bunk. If you encounter content or behavior that violates these Terms, you can report it in the app (via the report control on a profile, message, or match) or by emailing support@getbunk.app, and you can block any user to stop further contact. We review reports of objectionable content and abusive users and will act on them, including by removing content and removing the offending user, within 24 hours where appropriate. We may remove content, restrict features, or terminate accounts at any time to protect users, though we are not obligated to monitor all content and are not responsible for User Content posted by others.

7. Safety and interactions with other users

Bunk does not conduct criminal background checks, identity verification beyond what is described here, or any screening of users. We do not vouch for, endorse, or guarantee the identity, character, background, or conduct of any user. You are solely responsible for your interactions with other users, both online and in person, including any decision to communicate with, meet, tour housing with, share finances with, sign a lease with, or live with another user.

Use good judgment and take reasonable safety precautions. We recommend that you:

  • Meet for the first time in a public place and tell a friend or family member where you are going;
  • Independently verify any person, listing, lease, or payment before committing;
  • Never send money, deposits, or sensitive financial information to someone you do not know and trust;
  • Report suspicious, fraudulent, or harmful behavior to us and, where appropriate, to law enforcement.

To the fullest extent permitted by law, you assume all risk associated with your use of the Service and your interactions with other users, and you release RMA Media from any claims, demands, and damages arising out of or connected to any dispute or interaction with any user or third party.

8. Bunk Premium; subscriptions, billing, and cancellation

Bunk is free to join. We also offer an optional paid subscription, Bunk Premium, which unlocks additional features. Subscriptions are sold as an auto-renewing monthly subscription at the price shown to you in the app before you purchase (for example, $9.99 per month in the United States; prices may vary by region and over time).

  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
  • Your subscription automatically renews for successive periods of the same length unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Canceling stops future renewals but does not retroactively refund the current period.
  • Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
  • Refunds are handled by Apple or Google under their applicable policies. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
  • We may change subscription prices or features. We will give notice of a price change, and continued use after the change takes effect constitutes acceptance of the new price.

9. App stores and third-party services

You obtain the Bunk app through the Apple App Store or Google Play, and your use is also subject to those stores' terms. The Service may link to or rely on third-party services (such as our infrastructure and payment providers). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

10. Intellectual property

The Service and all associated software, design, text, graphics, logos, and other content (excluding User Content) are owned by RMA Media or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction or obligation to you.

11. Privacy

Our Privacy Policy describes how we collect, use, and share your information. By using the Service, you consent to those practices.

12. Changes to the Service

We are continually improving the Service and may add, change, suspend, or discontinue features at any time without liability. We may also impose limits on certain features or restrict access to parts of the Service.

13. Suspension and termination

You may stop using Bunk and delete your account at any time from within the app or by contacting us. We may suspend or terminate your access, remove content, or close your account at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Service or other users. Sections that by their nature should survive termination (including Sections 4, 7, 10, 14, 15, 16, 17, and 20) will survive.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, RMA Media disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected, and we make no warranty regarding any user, match, content, or the results of using the Service. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RMA MEDIA AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, arising out of or relating to your use of (or inability to use) the Service or your interactions with any user or third party, whether based on warranty, contract, tort, statute, or any other legal theory, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid RMA Media in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless RMA Media and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms or any law, or your interactions or disputes with any user or third party.

17. Dispute resolution; binding arbitration; class action waiver

Please read this section carefully. It affects your legal rights.

Informal resolution first. Before starting an arbitration, you agree to try to resolve the dispute informally by sending a written notice to support@getbunk.app describing the dispute and the relief you seek. You and RMA Media will attempt to resolve the dispute for 60 days after notice.

Binding arbitration. If the dispute is not resolved, you and RMA Media agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator will decide all issues, except that a court may decide the enforceability of the class action waiver below.

Class action and jury waiver. You and RMA Media agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and RMA Media waive any right to a jury trial.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@getbunk.app within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out will not affect any other part of these Terms.

Small claims and injunctive relief. Either party may bring an individual claim in small claims court if it qualifies. Nothing in this section prevents either party from seeking injunctive or equitable relief for infringement or misuse of intellectual property.

Governing law and venue. These Terms and any dispute are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and, where applicable, by the Federal Arbitration Act. To the extent a claim is not subject to arbitration, you and RMA Media consent to the exclusive jurisdiction of the state and federal courts located in California.

18. Additional terms for Apple devices

If you use the Bunk app on an Apple device, the following additional terms apply, and you acknowledge and agree that:

  • These Terms are between you and RMA Media only, and not with Apple Inc. ("Apple"). RMA Media, not Apple, is solely responsible for the app and its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection or similar laws.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You must comply with applicable third-party terms of agreement (for example, your wireless data plan) when using the app.

19. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (such as in the app or by email). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and delete your account.

20. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and RMA Media regarding the Service and supersede any prior agreements.
  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices and electronic communications. You consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
